Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody
A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.
The case originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an mistake. After his repatriation to the United States to face human smuggling allegations, he was detained in immigration detention.
In her order, the judge noted that the government does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
